In short: Midnight Alibi is a puzzle game with cases you can play for free. Case Files: Volume 1 is a one-time purchase that is yours to keep. The Detective’s Pass is a subscription that renews until you cancel it in Google Play or your Apple Account. Google Play or Apple takes your payment. Play fairly on the leaderboards, and don’t copy the game. This summary is here to help: the terms below are the agreement between us.
Who we are
Midnight Alibi is published by Zweifel Tech LLC, an Illinois limited liability company (“we”). These terms cover the Midnight Alibi app and today’s case on the web at midnight-alibi.web.app. By installing or playing the game, you agree to them. If you don’t agree, please don’t use it.
The game is not directed at children. If you are under the age of majority where you live, a parent or guardian must agree to these terms with you and make any purchase. The privacy policy explains how information is handled.
iPhone and iPad
If you got the app from the App Store, Apple’s Licensed Application End User License Agreement is your license for the app, and the seller is the one named on the App Store page. These terms apply alongside that agreement, which comes first if the two disagree.
Using the game
We give you a personal, non-commercial, non-transferable license to install Midnight Alibi and play it on devices you own or control, as your app store’s rules allow. The game and its cases, art and text belong to us. Your license doesn’t give you ownership of any of them. You’re welcome to share your results and talk about the cases.
You agree not to:
- copy, sell, rent or redistribute the game or its cases, art or text,
- take the game apart or try to extract its source code, except where the law allows it,
- use bots, scripts or modified copies of the app to open paid content or change your leaderboard standing,
- interfere with our services, overload them or try to get around their security,
- use the game in a way that breaks the law.
Free cases and what you can buy
- Free for everyone: the first 10 cases of each level, today’s case, and any daily case played on its day. Hard and Expert open as you rise through the detective ranks, with or without a purchase.
- Case Files: Volume 1 is a one-time purchase. It opens the first 100 cases of every level, 400 in all, and it is yours to keep. Use Restore purchases to bring it to a new device with the same Google or Apple account.
- The Detective’s Pass is an auto-renewing subscription, monthly or yearly. For as long as it lasts, it opens every case in Volume 1, every past daily case, the collection of Hard and Expert cases, and each volume to come.
A purchase belongs to the store account that made it. A purchase on Google Play doesn’t carry over to the App Store, or the other way around.
Subscriptions
- Renewal: the Pass renews automatically at the end of each month or year, and the store charges you for the next period, until you cancel.
- Cancelling: on Google Play, cancel at any time before the renewal date in your Google Play subscriptions. On the App Store, cancel at least 24 hours before the end of the current period in your Apple Account’s subscriptions. Deleting the app doesn’t cancel the Pass.
- When it ends: after you cancel, the Pass lasts until the end of the period you paid for. The cases it opened then close, except any case you have a saved game in, which stays playable. If you bought Volume 1, you keep it.
- Free trials: where a free trial is offered at purchase, it becomes a paid subscription when it ends, unless you cancel first. On the App Store, cancel at least 24 hours before the trial ends.
- Price changes: if the price of the Pass changes, the store tells you before it applies, as its rules require.
Prices and payment
The price is shown in the app and by the store before you buy, and it can differ by country. Google Play or Apple processes your payment under its own terms, and we never receive your payment details.
Refunds
- Google Play: Google Play’s refund policies apply. You can also write to us with your order number, and we’ll look at your request.
- App Store: Apple handles all refunds, and we can’t issue them. Request one from Apple at reportaproblem.apple.com.
- After a refund: what the purchase opened closes again, except any case you have a saved game in, which stays playable.
You may also have rights under the consumer law where you live, including, in the European Economic Area and the UK, a right to withdraw from some purchases within 14 days. Nothing in these terms takes those rights away.
Changes to the game
We update the game, and we may add, change or remove features. We may also change or stop online services such as Cloud Save, the leaderboards and today’s case on the web. The cases themselves are built into the app and work offline.
We won’t take away what you paid for: Volume 1 stays yours and keeps its cases, and the free cases stay free. If we ever stop offering the Pass, it will stop renewing and will last until the end of the period you paid for. If the app ever leaves the stores, an installed copy keeps working, but we can’t promise that future devices will be able to install or run it.
Cloud Save and leaderboards
Cloud Save and the public leaderboards are optional, and the privacy policy describes how they work. We may hide or remove a leaderboard entry, or reset its standing, if it comes from a modified copy of the app, tampering or other unfair play.
You can stop using the game at any time by deleting it, but remember that this doesn’t cancel the Pass. If you break these terms, we may remove you from the leaderboards and end your use of Cloud Save.
No warranty
We work to keep the game reliable, but it is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the game will be free of errors or always available, or that saved progress will never be lost.
Limits on liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data. Our total liability for any claim about the game is limited to the greater of what you paid for it in the 12 months before the claim and US$25.
Nothing in these terms limits a right or a liability that the law doesn’t allow to be limited. If you are a consumer in the European Economic Area or the UK, you keep your legal rights, including your rights if digital content is faulty or not as described, and this section and the one above apply only as far as your local law allows.
Governing law and disputes
If something goes wrong, please write to us first: most problems can be fixed quickly. These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law rules, and disputes go to the state or federal courts in Illinois. If mandatory consumer law where you live gives you stronger protection, or the right to bring a claim in your home courts, these terms don’t take that away.
Changes to these terms
If these terms change, the updated version will be posted on this page with a new effective date. If a change matters to how you use the game, we’ll also say so in the app or on this page before it applies. Continuing to play after that date means you accept the new terms. If you don’t accept them, stop using the game and cancel the Pass if you have it. A change won’t take away a purchase you have already made.
Other terms
These terms and the privacy policy are the whole agreement between you and us about the game, alongside your store’s own terms. If a court finds that part of these terms can’t be enforced, the rest still applies. You can’t transfer these terms to anyone else. We may transfer them to a company that takes over the game, and your rights under them stay the same.
